Robert Malove
Robert David Malove is an American criminal defense attorney based in Fort Lauderdale, Florida, and the founder of The Law Offices of Robert David Malove, a criminal defense firm in private practice since 1996.[1][2] He was admitted to The Florida Bar in 1984 and has been Board Certified by the Bar in Criminal Trial Law since 2005.[3] A former Assistant Public Defender with a master's degree in forensic science, he is a founding member of the National College for DUI Defense (NCDD) and co-author, with Benson Weintraub, of the Thomson West treatise White Collar Crime: Health Care Fraud.[4][5][6]
His practice covers DUI, federal criminal defense, white-collar crime including health care and Medicare fraud, criminal appeals and post-conviction relief in Florida state courts and in federal courts.[1][7] He holds an AV Preeminent peer review rating from Martindale-Hubbell and has been selected for Florida Super Lawyers in 2010–2011 and every year from 2014 to 2026.[8][7] He has also appeared as a guest legal commentator on Court TV.[4][9]
Education [edit]
Malove earned a Bachelor of Science in the administration of justice from the American University School of Justice in Washington, D.C., in 1979, and a Master of Forensic Science (M.F.S.) from The George Washington University in 1981.[1][10][4] He received his Juris Doctor from Pepperdine University School of Law in 1983.[3][1]
In 2007 he completed a postgraduate certificate in healthcare corporate compliance at George Washington University and earned the Certified in Healthcare Compliance (CHC) designation through the Health Care Compliance Association's Compliance Academy; Justia states that the designation was renewed through 2011.[1][11]
Career [edit]
Public defender
According to his firm and NCDD biographies, Malove was recruited to join the Federal Bureau of Investigation after law school before becoming an Assistant Public Defender.[4][1] He was admitted to The Florida Bar on 24 September 1984, joined the public defender's office in Broward County that year, and spent the next twelve years as a public defender in Broward, Palm Beach and Miami-Dade counties.[3][10][4] In 1995 he was designated DUI Training Attorney at the Public Defender's Office in Miami.[4][10]
Private practice
Malove left public defense to open his own firm, The Law Offices of Robert David Malove, P.A., which has been in private practice since 1996.[2][a] The firm is headquartered in the Malove Law Building at 200 SE 9th Street in Fort Lauderdale, in Broward County's 17th Judicial Circuit, and The Florida Bar's directory lists its size as 21–50.[3] As of 2026 the firm's website lists nine offices in Florida: Fort Lauderdale, Fort Myers, Fort Pierce, Gainesville, Key West, Miami, Orlando, Sarasota and West Palm Beach.[13]
In an October 2025 press release announcing expanded access to its services across Broward County, the firm described Malove as its "founder and managing attorney" and claimed "over 125 years of combined experience" among its lawyers.[14][b] His firm biography styles him "Attorney & Forensic Scientist".[1]
DUI defense
Malove's DUI practice draws on his forensic science training. He completed the Metro-Dade Police Academy's Field Sobriety Testing Course and was issued a permit by the Florida Department of Law Enforcement to conduct breath alcohol testing on Intoxilyzer series breath testing instruments.[10][4]
He is a founding member of the National College for DUI Defense,[4][c] which according to its board certification rules "has been accredited by the ABA to certify lawyers in the specialty area of DUI Defense Law since 2004" and is "currently the only organization accredited by the ABA to certify lawyers in this area of law".[15] In 2013 he gave a presentation titled "Mastering Scientific Evidence" on the Intoxilyzer 8000 breath-testing instrument.[16] He is the author of the consumer guide How to Choose a DUI Lawyer in Florida, whose second edition appeared in 2015.[17][16]
Health care fraud and federal defense
Malove defends clients in health care and Medicare fraud investigations and prosecutions in federal court.[1][7] With Benson Weintraub he wrote White Collar Crime: Health Care Fraud, a treatise published by Thomson West in annual editions from 2009–2010 to 2014–2015; the 2009–2010 edition, which credits Malove "with contributions by", runs to 738 pages.[5][6][18] Reviewing the 2010–2011 edition for the National Association of Criminal Defense Lawyers magazine The Champion in October 2011, Jon May credited the work to "Benson Weintraub and Robert David Malove, Thomson West (2010)".[6]
He writes the Health Care Fraud Blog, which Super Lawyers refers to as his "Medicare Fraud Blog".[19][7] According to Super Lawyers and JustCharged, he has represented the Florida Academy of Pain Medicine, the Florida Academy of Physician Assistants, the American Academy of Pain Management and the Florida Society of Neurology, and filed an amicus curiae brief challenging Florida's pain clinic statutes.[7][20] In 2015 he published When the Feds Come Knocking: The Essential Guide to Fighting Federal Charges, a consumer guide to federal criminal defense, and spoke on the same subject.[21][16]
Bar admission and certification [edit]
Malove is a member in good standing of The Florida Bar (Bar number 407283) and of its Criminal Law Section, and the Bar's directory records no discipline in the preceding ten years; Avvo likewise reports "No misconduct found".[3][16] He has been Board Certified by The Florida Bar in Criminal Trial Law since 2005, a designation NCDD describes as certification as an "expert/specialist".[3][4][d]
He is admitted to practice in all Florida county and circuit courts, the First through Fifth Florida District Courts of Appeal and the Supreme Court of Florida,[1][10] as well as in the following federal courts:

Media and speaking [edit]
Malove has served as a guest legal commentator on Court TV, and his firm's video library hosts a clip titled "Robert Malove of Fort Lauderdale Appears on CourTV".[4][11][9]
In March 2026 WSVN 7News quoted him in its "Help Me Howard" segment as counsel for a South Florida couple whose neighbor had cameras pointed into their backyard; a judge ordered the cameras removed.[23] Malove told the station:
"A picture never lies. It's worth a thousand words."

Later that month Court TV reported that Malove had taken over as defense counsel in a Florida murder case after the defendant's previous lawyer withdrew. When Judge Gregory Green questioned a notice of unavailability filed for the scheduled trial dates, Malove told the court, "This is not going to be going to trial."[24]
His recorded speaking engagements include "Mastering Scientific Evidence" (2013), on Intoxilyzer 8000 breath testing, and "When the Feds Come Knocking" (2015), on federal criminal defense.[16] He runs a YouTube channel and has posted on X as @RobertDMalovePA since September 2011.[1][25]

Martindale-Hubbell describes its AV Preeminent rating, which Malove has held since 1999, as "the highest peer rating standard", signifying that "a large number of the lawyer's peers rank him or her at the highest level of professional excellence".[8][2] Super Lawyers states that "each year no more than 5 percent of the attorneys in the state are selected".[7]

Notes [edit]
- Lawful.com describes the firm as "founded in 1984", the year of Malove's bar admission.[12] Martindale-Hubbell data gives private practice since 1996, consistent with the firm's account of twelve years in public defense from 1984.[2][10]
- The October 2025 release listed six offices (Fort Lauderdale, Fort Myers, Palm Beach County, St. Lucie County, Key West and Orlando); the firm's website now lists nine.[14][13]
- The firm's About Us page dates his founding membership to 1995; Avvo lists it from 1996. NCDD's own founding year is reported variously as 1994 and 1995.[10][16]
- The firm's website describes the certification as being in "criminal law"; The Florida Bar's record specifies Criminal Trial Law.[1][3]
- Avvo's honors list also includes Super Lawyers selections for 2006 and 2007, which do not appear on the Super Lawyers profile itself.[16][7]
